Terms of Service

Article 1 (Purpose)

These Terms govern the conditions and procedures for using "Retengo" ("the Service"), the D2C retention and review-request automated email service provided by Retengo ("the Company"), and the rights and obligations of the Company and users (merchants).

Article 2 (Description of the Service)

The Company provides segment extraction and automated email sending based on data from the store platform (Cafe24, Shopify, etc.) a merchant has connected. The Company does not separately store a merchant's order/customer data; it retrieves and processes it in real time only at the moment a send is needed (BYO-data).

Article 3 (Data Connection & User Responsibility)

  • Merchants grant only read-only access (order/customer lookup) via OAuth consent.
  • Merchants bear full responsibility for lawfully obtaining and managing end-user (shopper) marketing consent under applicable law; the Company does not warrant the legality of data a merchant connects or uploads.
  • The Company acts as a processorproviding an email sending system per the merchant's instructions; any legal disputes, administrative sanctions, or fines arising from actual send content or the validity of consent obtained are the merchant's responsibility and expense to resolve.
  • If a merchant is reasonably suspected of violating applicable law, or a legitimate spam complaint is received, the Company may suspend the Service or terminate the agreement without prior notice.

Article 4 (Disconnection & Data Deletion)

Merchants may disconnect their connected store (Cafe24, Shopify, etc.) at any time from the Connections screen, with no separate inquiry or approval process required. Upon disconnection, the Company immediately:
  • Permanently destroys the encrypted OAuth authentication token
  • Deletes the merchant's cached consent-status data (opt-in/opt-out records, etc.)
  • Records an audit log of the disconnection itself (who/when)
Because the Company does not separately retain a copy of the original order/customer database, after disconnection it can no longer access any of that merchant's customer data.

Article 5 (Fees & Payment)

The Service is currently provided free of charge during the beta period. After official launch, Free, Starter, and Pro paid plans will apply — see the pricing section on our homepage for plan details. The exact billing start date and payment method will be announced separately and will require users' explicit consent before taking effect. Usage fees from third-party services (e.g. Resend) may apply.

The Pro plan's email sending is provided as fair use up to 100,000 emails per month. If usage is found to exceed this on a sustained basis, the Company may, after prior notice, discuss adjustments with the user (e.g. a plan change or usage-based pricing), and may temporarily hold sends above the threshold pending that discussion.

Per-plan contact limits are calculated based on the number of contacts with opted-in marketing consent. Contacts in a pending or opted-out state are not counted toward this limit and are stored and managed without restriction.

Article 6 (Prohibited Conduct)

Sending marketing communications without consent, spam, unauthorized use of others' information, and abnormal access attempts against the system — any conduct violating applicable law (Personal Information Protection Act, Act on Promotion of Information and Communications Network Utilization, and where applicable international laws such as CAN-SPAM/CASL/GDPR) are prohibited.

Article 7 (Limitation of Liability)

The Company is not liable for damages arising from causes beyond its reasonable control, including force majeure or failures of third-party services (store platform APIs, sending infrastructure, etc.). As stated in Section 3, the Company is also not liable for damages arising from the legality of data a merchant provides or connects.

Article 8 (Governing Law & Jurisdiction)

These Terms are governed by the laws of the Republic of Korea. Disputes arising from use of the Service shall be brought before the court having jurisdiction under the Korean Civil Procedure Act.
